Unit 6: Civil Liberties & Civil Rights

Civil Liberties

Civil Liberties are known as rights which are given; they should not be taken away under any circumstances. Examples of such liberties include:
  • Freedom of Speech
  • Privacy
  • Freedom from unreasonable searches
  • Rights to a fair trial
  • Right to marry

Civil Rights

Civil Rights are the responsability of the government to ensure equal treatment to all people, regardless of race, religion, or gender.

Civil Rights and Liberties are found in several of the first amendments of the Constitution, known as the Bill of Rights. The 1st Ammendment gives the rights of Freedom, Press, Religion, Speech, and Assembly to the people. The 4th amendment protects ctizen's liberties of freedom from unreasonable searches. The 5th amendment protects against self incrimination, and the 6th ammendment gives the right to council. Finally, the 8th amendment outlaws cruel and unusual punishment.

While the Constitution does not directly mention the "right to privacy," it is implied in the Constitution.

Other Civil Liberties and Rights are derived from documents such as the Civil RIghts Act of 1964 and the Voting Rights Act of 1965.

Over time, Civil Rights and Liberties have evolved from being given to mainly white men who owned property, to blacks and women as well. In addition, the rights of the modern age evolved from being specifically expressed in the Constitution, to rights which are implied to be possessed by citizens, such as privacy.
